TERMS OF SERVICE AGREEMENT


By commissioning, purchasing, or otherwise obtaining artwork, designs, or characters created by BlueChimera; Also previously known as BlueGeckko (hereafter referred to as “the Artist”), you (“the Client”) acknowledge that you have read, understood, and agreed to the following Terms of Service.All artwork and designs are digital-only. No physical goods will be provided.

I. ARTIST RIGHTS & LICENSE GRANT

I.I The Artist retains full and absolute ownership of all artwork and designs, including all copyrights and reproduction rights, unless otherwise explicitly transferred in writing.
I.II The Client is granted a non-exclusive, non-transferable license to use the artwork or design for personal, non-commercial purposes only, unless otherwise agreed upon in writing.
I.III The Artist reserves the right to:Display the artwork on social media, websites, portfolios, and promotional materialsArchive, repost, or reference the artwork as part of completed commissions or sold designsI.IV The Client may not:Claim authorship of the artwork or designRemove or obscure artist credit or watermarksTrace, copy, edit, or redistribute the artwork beyond permitted personal useI.V Commercial use, resale-based projects, branding, merchandise, NFTs, AI training, or dataset usage are strictly prohibited unless explicitly agreed upon in writing.


II. CONTENT & MORAL RESTRICTIONS

II.I All artwork and designs are safe-for-work by default.II.II The Client shall not use the artwork or design in connection with content that is illegal, exploitative, or harmful, including but not limited to:Zoophilia or bestialityPedophilia or sexual content involving minorsIncest or sexualized familial relationshipsHate content or abuse glorificationII.III NSFW usage requires prior, explicit permission from the Artist and may be revoked at any time.II.IV Violation of this section constitutes a material breach and may result in immediate revocation of ownership and usage rights.


III. COMMISSIONS — PROCESS & PAYMENT

III.I Commissions are not first-come, first-served. The Artist reserves the right to accept or decline any commission request.III.II Full payment is required upfront via PayPal or Ko-fi unless otherwise agreed upon in writing.III.III No work will begin until payment has been received in full.III.IV Revisions:Edits may be requested during the sketch phaseOnce a sketch is approved, major changes are no longer permittedAdditional changes may require extra feesIII.V Refunds are not provided once work has begun, except in cases of prolonged failure to communicate by the Artist.

III.VI Bidding & Auction Policy

III.VI.I Bids must only be placed if the Client has the funds readily available and is fully prepared to complete payment if declared the winning bidder. Bidding without secured funds or with uncertainty regarding payment is strictly prohibited.III.VI.II A bid is considered winning after forty-eight (48) hours have passed without a higher bid being placed.III.VI.III Once declared the winning bidder, the Client has forty-eight (48) hours to submit full payment unless the original bid explicitly stated a payment plan and such payment plan was formally accepted by the Artist.III.VI.IV Payment plans are only valid if clearly stated at the time of bidding and explicitly approved by the Artist. Unapproved payment plans are not binding.III.VI.V Failure to complete payment or communicate within the allotted forty-eight (48) hours constitutes a breach of agreement. The Artist reserves the right to revoke the win, re-list the adopt, and pursue enforcement actions.III.VI.VI Withdrawing a bid (whether generally or for the purpose of placing a bid on another adopt) is considered disruptive conduct.III.VI.VII Enforcement Policy:
- First offense: Formal warning
- Second offense: Permanent ban from future bidding and potential block from future transactions


IV. TURNAROUND TIME

IV.I Turnaround time varies based on workload, health, college obligations, and project complexity.IV.II Estimated completion times are not guarantees.IV.III The Client may request progress updates at reasonable intervals.


V. DESIGNS & ADOPTABLES — USE & MODIFICATION

V.I Minor to moderate redesigns are permitted provided the design remains recognizable.V.II Sibling, alternate universe, or kin versions are permitted.V.III Core elements (base palette, defining traits) may not be fundamentally altered without written permission.V.IV The Client must credit the Artist as the original designer wherever the design is publicly displayed.V.V The Client may not draw over, edit, or otherwise alter the Artist’s original artwork. Any redesigns or edits must be created on a new drawing or base.


VI. OWNERSHIP, VISIBILITY & ABANDONMENT

VII. SELLING, TRADING & TRANSFERS

VII.I Designs obtained through trades, raffles, or freebies are non-monetary unless additional commissioned artwork has been added.VII.II Purchased designs may be resold for no more than their original purchase price unless increased by added artwork.VII.III Gifts, unrelated trades, or third-party value do not increase resale value.VII.IV Designs may not be transferred to known problematic users, hoarders, or blacklisted individuals.


VIII. PAYMENT PLANS

VIII.I Payment plans are offered at the Artist’s discretion.VIII.II Ownership remains with the Artist until full payment is received.VIII.III Failure to complete payments results in forfeiture of the design without refund.VIII.IV Failure to communicate for thirty (30) days may result in the design being frozen or reclaimed.


IX. CHARGEBACKS & FRAUD

IX.I Filing a chargeback without prior discussion constitutes a breach of this Agreement.IX.II Consequences include:Immediate revocation of ownership and usage rightsPermanent blacklist from future transactionsIX.III The Artist reserves the right to dispute chargebacks and retain payment if work was delivered as agreed.


X. PAYMENT HANDLING & DISTRIBUTION INVOLVING COLLABORATIONS

X.I Unless explicitly agreed otherwise in advance, I, BlueChimera, will manage all payments related to collaborative adopts or designs. Alternative payment arrangements may be discussed, but I reserve the right to decline them.X.II I commit to:Distributing all funds fairly and according to the agreed revenue splitNever withholding, manipulating, or attempting to claim more than my agreed sharePaying collaborators their full portion in a timely mannerX.III All payments are handled via PayPal.X.IV Example payment methods include:The buyer pays the full amount to BlueChimera, after which the collaborator receives their agreed percentageThe buyer is instructed to split payment directly between collaborators based on the agreed percentagesX.V Regardless of method, the original agreed split remains unchanged and fully enforced.


XI. BLACKLIST & ENFORCEMENT

XI.I The Artist reserves the right to refuse service and restrict ownership at their discretion.XI.II Designs may not be transferred to individuals on the Artist’s blacklist or graylist.


XII. Base Usage & Restrictions

XIII.I All files sold via Ko-fi, Patreon Shop, Payhip, or other official channels are strictly digital, safe-for-work resources. No adult, explicit, or NSFW content is included.XIII.II Upon purchase of a base, the Client may:Create original designs for personal use or to make adoptables for saleMake reference sheets for pre-existing characters they ownAccept custom design commissions using the base for clientsXIII.III The Client may set prices for designs or commissions using the base at their discretion.XIII.IV The Client may not remove the watermark from the base. Minor adjustments to color or size are permitted, provided the watermark remains recognizable and readable.XIII.V Only PNG or PSD files are sold unless otherwise specified. Requests for alternate file types will not be accommodated.XIII.VI Under no circumstances may the Client:Sell or redistribute the base itselfShare base files with others without purchasingUse the base in any zoophilic, pedophilic, or otherwise prohibited contentXIII.VII Mixing bases is permitted, including with other artists’ bases, with proper credit. All mixed usage must respect the rights of all original creators.XIII.VIII Marketing and commercial rights:Bases may not be used in merchandise, prints, media, or other commercial products without permissionViolation may result in blacklistingXIII.IX Credit must always be given to the Artist, ideally linking back to my store or socials. Simple credit like “Base by BlueChimera” is acceptable, but links are preferred.XIII.X All base purchases are final. No refunds are provided.XIII.XI Free bases are excluded from these terms. Free bases may not be used for YCHs, paid customs, or any form of monetary commissions.


XIII. FINAL PROVISIONS

XII.I The Artist reserves the right to update these Terms at any time.XII.II Continued use, ownership, or commissioning constitutes acceptance of the most recent version.XII.III These Terms exist to protect both parties and promote ethical artistic exchange.
